[♪♪♪]>>GOOD EVENING AND WELCOME TO “CHICAGO TONIGHT.” I’M BRANDIS FRIEDMAN. COMING UP ON THE PROGRAM… ONE-ON-ONE WITH COOK COUNTY’S STATE’S ATTORNEY KIM FOXX A WEEK AFTER NEW CHARGES ARE FILED AGAINST ACTOR JUSSE SMOLLETT. WHAT MORE MONEY COULD MEAN FOR ILLINOIS’ PLAGUED CHILD WELFARE AGENCY. OUR MEDICAID PATIENTS BEING PRESCRIBED TOO MANY ANTIBIOTICS? VISITING A RUTH BADER GINSBURG EXHIBITION WITH HER SON.>>AND ON THIS PRESIDENT’S DAY A LOOK HOW THE PRESIDENCY CHANGED OVER THE YEARS. BUT FIRST, TONIGHT HOW THE CITY IS RESPONDING TO A CALL FOR INCREASED IMMIGRATION ENFORCEMENT IN SANCTUARIES CITIES HERE IS CAROL MARIN.>>THANK YOU. ELITE BORDER PATROL AGENTS ARE SET TO BE DEPLOYED TO SANCTUARY CITIES INCLUDING CHICAGO TO WORK WITH LOCAL I.C.E. AGENTS TO ARREST UNDOCUMENTED IMMIGRANTS. THE DEPLOYMENT FIRST REPORTED BY THE NEW YORK “THE NEW YORK TIMES” IS SET TO RUN THROUGH THIS MONTH INTO MAY. MAYOR LORI LIGHTFOOT PUSHED BACK ON THE PLAN BUT IMMIGRATION ENFORCEMENT OFFICIALS SAY IT’S NECESSARY TO DEAL WITH THE CHANGES THAT SANCTUARY CITIES POLICIES HAVE CREATED. JOINING US IS ERENDIRA RENDON THE VICE-PRESIDENT OF THE IMMIGRATION ADVOCACY AND DEFENSE PROJECT AT THE NONPROFIT THE RESURRECTION PROJECT. AND DAVID APPLEGATE A PARTNER AT THE FIRM OF WILL WORLD A MEMBER OF THE LIBERTARIAN LEGAL ORGANIZATION, THE FEDERALLALLIST SOCIETY AND ADVISER TO THE HEARTLAND INSTITUTE. WELCOME BACK BOTH OF YOU TO “CHICAGO TONIGHT.” ERENDIRA RENDON WHEN YOU HEARD THIS NEWS YOUR REACTION?>>YOU KNOW THERE IS AN IMMEDIATE REACTION OF FEELING NERVOUS AND FEAR. I, MYSELF AM UNDOCUMENTED, I AM DACA AND MY FAMILY IS UNDOCUMENTED. AND WE HAVE DONE A GREAT JOB AS A CITY TO MAKE SURE WE ARE PREPARED. WE HAVE A MAYOR WHO IS A CHAMPION AND WE HAVE ORGANIZATIONS THAT TRAINED THOUSANDS OF PEOPLE ON THEIR RIGHTS. AND SO WE ARE AS PREPARED AS WE CAN BE AND WE WILL CONTINUE TO PREPARE. AND WE WENT FROM FEAR KNOWING THAT WE ARE DOING THE RIGHT THING.>>DAVID, YOUR REACTION?>>I THINK IT IS A BIT OF A TEMPEST IN A TEAPOT, CAROL. WITH ALL RESPECT FOR THE RESURRECTION PROJECT AND CHICAGO’S IMMIGRANT COMMUNITY, WHAT’S HAPPENING HERE IS SIMPLY THE EQUIPMENT IF WE HAD A RASH OF STORE THEFTS OR SHOPLIFTING ON MICHIGAN AVENUE AND DETECTIVES WERE NOT ALLOWED TO DETAIN THESE SHOPLIFTERS UNTIL THE CHICAGO POLICE GOT HERE. BECAUSE SANCTUARY CITIES LIKE CHICAGO REFUSE TO COOPERATE WITH IMMIGRATION AND CUSTOMS ENFORCEMENT, THEY ARE THEN FORCED TO SEND MULTIPLE AGENTS OUT INTO THE COMMUNITY TO LOOK FOR PEOPLE WHO HAVE ALREADY RECEIVED FINAL ORDERS OF DEPORTATION. SO I DON’T THINK THAT THE IMMIGRANT COMMUNITY HERE SHOULD BE CONCERNED EXCEPT FOR THOSE WHO HAVE ALREADY BEEN THROUGH THE LEGAL PROCESS, HAVE HAD THEIR CLAIMS ADJUDICATED AND ORDERED DEPORTED AND RELEASED OUT INTO THE COMMUNITY BY THE SANCTUARY CITY POLICYIES OF THIS CITY AND OTHERS.>>ERENDIRA RENDON THERE IS DISPUTE ABOUT THAT FROM YOUR ORGANIZATIONS AND WHAT IS THAT DISPUTE?>>WE DON’T SEE THAT. WHAT WE SEE IS EVERYBODY GETTING PICKED UP AND ANYBODY GETTING PICKED UP. WE SEE A LOT OF COLLATERAL ARRESTS. WE SEE I.C.E. PULLING PEOPLE OVER AND PEOPLE BELIEVING THEY ARE REGULAR COPS. AND NOT ONLY DETAINING SOMETIMES A PERSON THAT IS DRIVING WITH A VALID DRIVER’S LICENSE WE GOT A CALL SATURDAY THE PASSENGER AS WELL. SO WE SEE A LOT OF RACIAL PROFILING AND WE DON’T SEE FOLKS ORDERED DEPORTED. WE HELP THEM TO FIGHT THEIR DEPORTATIONS.>>THERE IS AN ARGUMENT IT PUTS A CHILL IN THE AIR BOTH FOR COMMERCE AND FOR PEOPLE GOING ABOUT THEIR NORMAL BUSINESS. IN SOME WAYS THAT IS INTENDED, YES?>>ONE COULD ARGUE THAT IS INTENDED IN THE SAME WAY THAT ONE COULD ARGUE THAT AIRPORT SECURITY IS INTENDED TO PUT A CHILL ON THE POPULATION. ANYONE WHO GOES TO THE AIRPORT AND LOOKS AROUND AND KNOWS THERE IS NOT A TERRORIST STANDING IN THAT LINE. I, MYSELF. CAME BACK FROM MEXICO TWO DAYS AGO. I WAS PULLED OUT OF LINE. HAD MY LUGGAGE RUMMAGED THROUGH. WAS WANDED. HAD MY FINGERS AND MY BAGGAGE TESTED FOR POSSIBLE EXPLOSIVES. I HAD TO GO THROUGH CUSTOMS AND IMMIGRATION NOT ONLY IN MEXICO BUT WHEN I RETURNED TO THE UNITED STATES. HAD TAKE MY GLASSES OFF WAS PHOTOGRAPHED FOR VISUAL RECOGNITION. ALL OF THESE THINGS ARE DONE IN THE NAME OF PUBLIC SAFETY AND THE RULE OF LAW AND ENFORCING IMMIGRATION LAW. SO WAS I BEING SINGLED OUT BECAUSE I’M OLDER, WHITE MALE? AM I BEING DISCRIMINATED AGAINST? NO THESE ARE UNIFORM POLICIES THAT ARE BEING UNIFORM ALI ENFORCED TO UPHOLD FEDERAL IMMIGRATION LAW WHICH I POINT OUT UNDER THE CONSTITUTION OVERRIDES ANY STATE OR LOCAL SANCTUARY LAWS.>>TO THAT POINT, ERENDIRA RENDON, WHY SHOULDN’T THERE BE COOPERATION WITH IMMIGRATION OFFICIALS? THEY CARRY THE MANDATE OF THE FEDERAL GOVERNMENT. THEY ARE LEGALLY AUTHORIZED. WE SHOULDN’T THEY BE COOPERATED WITH?>>YOU KNOW, I THINK THAT THE LAW ENFORCEMENT AND LOCAL LAW ENFORCEMENT IS MOST INTERESTED IN PUBLIC SAFETY. AND YOU KNOW EVEN ACCORDING TO THE POLICE CHIEF’S ASSOCIATIONS AROUND THE COUNTRY, THEY KNOW THAT IF FOLKS ARE FEARFUL OF COMING FORWARD YOU CREATE SILENT VICTIMS PEOPLE WILL BE SCARED OF REPORTING CRIME AND IT DOESN’T HELP ANYBODY. AND EVERY STUDY THAT IS OUT THERE SHOWS THAT SANCTUARY CITIES ARE SAFER THAN CITIES THAT DON’T HAVE WELCOMING POLICIES. OUR INCOME IS HIGHER. AND WHAT YOU HAVE IS THEN COMMUNITIES ABLE TO CALL THE POLICE WHEN THEY FEEL THAT THREAT OR SEE A CRIME SO THEY CAN COOPERATE. AND THAT IS AT THE END OF THE DAY, THE JOB OF LOCAL LAW ENFORCEMENT AND THAT IS THEIR MISSION SO THEY ARE WELL AWARE THAT COOPERATING WITH I.C.E. WILL ONLY DERAIL THE TRUST THAT EXISTS BETWEEN THE COMMUNITY AND THE POLICE.>>THERE IS SKEPTICISM OF THE TIMING OF THIS, DAVID, BECAUSE THE CENSUS IS BEING LAUNCHED. AND IF PEOPLE ARE NOT ON THE STREETS OR WON’T COME OUT OF THEIR HOUSES AND SANCTUARY CITIES TEND TO BE MORE DEMOCRAT THAN REPUBLICAN, THAT THERE MAY BE A SUPPRESSION OF THE CENSUS ON BEHALF OF THAT.>>WELL, ULTIMATELY, EVERYTHING IS POLITICAL, PARTICULARLY IN AN ELECTION YEAR. BUT WE’VE HAD THIS DISCUSSION BEFORE ON THIS SHOW. AND THE ANSWER IS NOT REFUSAL TO COOPERATE. THE ANSWER IS EDUCATION. AND CHICAGOANS AND OUR VIEWERS NEED TO BE EDUCATED TO KNOW THAT THIS IS NOT A ROUNDUP OF PEOPLE WHO ARE HERE ILLEGALLY WHO HAVE OVERSTAYED THEIR VISAS. THESE ARE PEOPLE WHO ACTUALLY ARE SUBJECT TO ORDERS OF DEPORTATION.>>HOW DO WE KNOW IT IS NOT A ROUNDUP? HOW DO WE DETERMINE WHAT MAY NOT BE A ROUNDUP BY DEFINITION MAY FEEL LIKE A ROUNDUP NONETHELESS, RIGHT?>>LET’S GO BACK TO AIRPORT SECURITY. WE DO IT TO EVERYBODY. IT IS A UNIFORMLY ENFORCED LAW BECAUSE WE THINK THAT THERE IS SOMETHING OUT THERE THAT NEEDS PROTECTION.>>AND BY EXTENSION SANCTUARY CITIES ARE NOT FEDERALLY MANDATED UNDER LAW. I MEAN THEY ARE REALLY THE THEORY OF A LOCAL GOVERNMENT TO DECLARE IT BUT THERE IS NOT MUCH THAT IS GUARANTEED BY IT, ISN’T THAT CORRECT?>>MOST WELCOMING POLICIES ARE SANCTUARY POLICIES. IT’S BASICALLY STATING THERE IS NOT GOING TO BE COOPERATION BETWEEN LOCAL LAW ENFORCEMENT AND I.C.E. IF SOMEBODY HAS A DETAINER I.C.E. SAID PLEASE 0 HOLD THIS PERSON FOR 48 HOURS WHICH MANY COURTS FOUND UNCONSTITUTIONAL THEN WHAT CITIES LIKE CHICAGO WHAT WE’RE SAYING WE ARE NOT GOING TO DETAIN PEOPLE FOR I.C.E. TO COME AND PICK THEM UP. I.C.E. GOES AROUND INTO THE STREETS AND DOES PULL PEOPLE OVER, DOES GO TO PEOPLE’S HOMES, DOES ARREST PEOPLE AND START THEIR DEPORTATION AND PUT IMMIGRANTS IN DETENTION. WHAT SANCTUARY POLICIES ARE IS THAT THE CITY IS NOT GOING TO HELP FACILITATE THAT.>>THERE ARE THINGS THAT YOUR ORGANIZATION RECOMMENDS PEOPLE DO. MAINLY WHAT IS THAT?>>FIRST AND FOREMOST IF I.C.E. COMES TO YOUR HOME AND KNOCK ON YOUR DOOR YOU HAVE RIGHTS TO NOT OPEN THE DOOR UNLESS THEY HAVE A SIGNED WARRANT AND IF THEY HAVE A SIGNED WARRANT THEY WILL OPEN THE DOOR THEMSELVES. IF YOU ARE IN CONTACT WITH I.C.E., YOU HAVE THE RIGHT TO REMAIN SILENT AND IF YOU ARE DETAINED BY I.C.E. ALL YOU HAVE TO DO IS GIVE YOUR NAME AND DAY OF BIRTH YOU DON’T HAVE TO ANSWER QUESTIONS AND YOU SHOULD NOT SIGN DOCUMENTS AND YOU HAVE THE RIGHT TO SEEK COUNSEL. WE ENCOURAGE PEOPLE TO REACH OUT TO OUR ORGANIZATION TO MAKE SURE THAT YOU ARE ABLE TO RECEIVE LEGAL ADVICE.>>DAVID, PREVIOUS THREATS OF ENHANCED IMMIGRATION ENFORCEMENT HAVE NOT REALLY MATERIALIZED OR CREATED A GREAT EFFECT. WHY WOULD THIS ONE BE DIFFERENT DO YOU SUPPOSE, IF YOU SUPPOSE?>>WELL, I’M NOT SURE ABOUT THE PREDICATE TO THAT QUESTION, CAROL BUT LET’S LOOK AT SOME NUMBERS FROM. FISCAL YEAR 2017 TO FISCAL YEAR 2019, ACCORDING TO CUSTOMS AND BORDER PATROL WE HAVE GONE FROM 2.4 MILLION TO 3.4 MILLION UNDETAINED, ILLEGAL ALIENS WHO ARE SUBJECT TO DEPORTATION. WE HAVE 5300 I.C.E. OFFICERS WHO ARE IN THE CATEGORY OF BEING ABLE TO KNOCK ON DOORS. THEIR WORKLOAD HAS GONE UP. IT IS A WASTE OF TAXPAYERS MONEY OF FEDERAL TAXPAYERS TO BE PAYING THOSE PEOPLE ONLY TO BE FOUGHT TOOTH AND NAIL BY CITIES AND STATES. AND SO WE ARE CALLING UP ADDITIONAL PEOPLE FROM THE BORDER WHO HAVE THE SAME TRAINING. THEY ARE NOT GOING TO BE KICKING IN DOORS. THEY ARE NOT GOING TO BE USING TEAR GAS. THEY ARE NOT GOING TO HAVE ARMORED CARS OR ANYTHING LIKE THAT THEY ARE SIMPLY ADDING TO THE WORKFORCE TO DO THE JOB THAT CONGRESS WHICH MAKES THE IMMIGRATION LAWS DECIDED THEY SHOULD DO.>>DAVID APPLEGATE AND ERENDIRA RENDON WE THANK YOU FOR BEING WITH US. I THINK THIS DISCUSSION WILL CONTINUE IN FURTHER PROGRAMS. “CHICAGO TONIGHT” JUST AHEAD, MUCH MORE STAY WITH US.>>EMBATTLED STATE’S ATTORNEY KIM FOXX IS SPEAKING OUT TODAY A WEEK AFTER A SPECIAL PROSECUTOR REINDICTED ACTOR JUSSE SMOLLETT. THE SPECIAL PROSECUTOR CALLED INTO QUESTION THE STATE’S ATTORNEY’S JUDGMENT IN DROPPING 16 CHARGES AGAINST SMOLLETT. FOXX IS RUNNING FOR REELECTION AGAINST PRIMARY CHALLENGES, BILL CONWAY, DONALD TRUMP AND BOB FIORETTI FEE FEE. AND>>BRANDIS FOXX DISPUTES A LOT OF THE CLAIMS MADE BY THE SPECIAL PROSECUTOR DAN WEBB ESPECIALLY HIS CONTENTION THAT SHE HAS NOT TURNED OVER EVIDENCE THAT ANYONE ELSE WOULD GET THE SAME TREATMENT. WEBB CHARGED SMOLLETT WITH DISORDERLY CONDUCT AND FILING FALSE POLICE REPORTS FOR ALLEGEDLY STAGING THAT RACIST AND HOMOPHOBIC ATTACK ON HIMSELF ABOUT A YEAR AGO. WEBB IS ALSO REVIEWING THE CONDUCT OF FOXX’S OFFICE AND FOXX’S CAMPAIGN INITIALLY CALLED THE TIMING OF WEBB’S CHARGES QUOTE JAMES COMEY LIKE INSINUATING HE IS DOING IT TO HURT HER REELECTION CAMPAIGN. TODAY SHE DID A PARTIAL WALK BACK.>>RECOGNIZE IT IS CAMPAIGN SEASON WE ARE A MONTH OUT AND HE REACHED HIS CONCLUSION AT THAT TIME.>>YOU ARE THINKING HE SHOULD HAVE WAITED UNTIL AFTER THE PRIMARY?>>I’VE ALWAYS SAID THIS SHOULD BE A NONPOLITICAL REVIEW OF THIS CASE. I CALLED FOR A REVIEW OF THIS CASE BACK IN MARCH AND HOPING TO TAKE POLITICS OUT OF IT. THE FACT IT’S COME IN THE MIDDLE OF AAND ELECTION SEASON I COULD NOT HAVE PREDICTED THAT BUT IT IS WHAT IT IS.>>AND PARIS, HOW DID FOXX REACT TO HER CONDUCT?>>WEBB SAID HE DISAGREED WITH HER OFFICE’S DECISION TO DROP THE CHARGES. FOXX HAD SAID THIS IS SIMILAR TO HOW WE HANDLE OTHER CASES LIKE THIS. BUT WEBB SOUGHT DOCUMENTARY EVIDENCE TO BLACK THAT CLAIM UP AND HE DID NOT GET ANY. AND I HONED THAT IN ON FOXX AND SHE SAID THAT WEBB WILL FIND WHAT HE IS LOOKING FOR.>>WE SAID WE WILL BE COOPERATIVE WITH THE INFORMATION THEY WANT FROM US AND WE WILL CONTINUE TO DO SO.>>THERE ARE CASES YOU ARE SAYING THAT ARE SETTING PRECEDENT FOR THIS ARRANGE MANY?>>ABSOLUTELY.>>CAN YOU POINT ME TO ONE?>>AT THIS MOMENT I CAN TELL YOU THAT OUR OPEN DATA PORTAL WILL TELL YOU ALL THE DISORDERLY CONDUCT CASES THAT HAVE BEEN REFERRED TO OUR OFFICE AND THE CASES THAT HAVE BEEN CHARGED AND DISPOSED OF BY ALTERNATIVE PROSECUTION. I’M PROUD THAT WE ARE TRANSPARENT OFFICE, THE MOST TRANSPARENT OFFICE IN THE COUNTRY WITH EVERY FELONY LEVEL DATA POINT ON OUR OPEN DATA PORTAL. THAT INFORMATION –>>YOU ARE SAYING Mr. WEBB WILL FIND THIS DOCUMENTARY EVIDENCE OF SIMILAR ALTERNATIVE PROSECUTIONS FOR SIMILAR TYPE CASES?>>ABSOLUTELY.>>AND PARIS, WE HAVE MENTIONED SHE IS FACING REELECTION. HOW DOES THIS AFFECT THAT?>>YOU MENTIONED THE THREE PRIMARY OPPONENTS, BILL CONWAY, DONNA MOORE AND BOB FIORETTI AND THEY BELIEVE HER OFFICE IS SHOWING FAVORITISM FOR THE POLITICALLY CONNECTED.>>YOU CANNOT HAVE A CRIMINAL JUSTICE SYSTEM THAT YOU BELIEVE IN IF THE POLITICALLY CONNECTED ARE GETTING ONE DEAL AND REGULAR FOLKS LIKE MY CLIENT CANDICE CLARK ARE GETTING A DIFFERENT DEAL AND IT IS NOT RIGHT AND THAT IS NOT A CRIMINAL JUSTICE SYSTEM WE CAN BELIEVE IN.>>WITH THE NEW EVIDENCE THAT CAUSED THE SPECIAL PROSECUTOR TO REINDICT, IT LOOKS LIKE THERE WAS SOMETHING AMISS AT THE STATE’S ATTORNEY’S OFFICE.>>ANY CRIMINAL COMPLAINT THAT IS FILED ANY CIVIL COMPLAINT FILED ON BEHALF OF THE COUNTY, THAT BEARS THE STATE OF ILLINOIS AND HAS HER NAME ON IT, IS JUST TAINTED. SHE MUST GO AND SHE SHOULD RESIGN NOW.>>FOXX TODAY REPEATEDLY TRIED TO CHANGE THE FOCUS OFF OF SMOLLETT AND TO HER ACCOMPLISHMENTS LIKE EXONERATING THE RECORDS OF POT OFFENDERS AND A REALLOCATION OF RESOURCES TO FIGHT REPEAT GUN OFFENDERS AND ONLY THE MOST SERIOUS OF FELONIES. FOLKS SHOULD HAVE BEEN AFFECTED ARE SICK OF THE SMOLLETT STORY.>>DOES IT ANNOY ME THAT THERE ARE PEOPLE WHO HAVE AN OPPORTUNITY TO HAVE AN ALTERNATIVE PROSECUTION AND CHOOSE TO USE THAT TO ELEVATE THEMSELVES? SURE. BUT I DON’T FOCUS ON THAT. I CAN’T FOCUS ON THAT. THERE ARE PEOPLE COUNTING ON US IN NEIGHBORHOODS EVERYDAY TO DO OUR JOBS WITHOUT CONCERN OF POLITIC OR CELEBRITY. AND SO HE CAN BE ANNOYED. BUT I DO MY JOB.>>OBVIOUSLY REFERRING TO HER FEELINGS ABOUT JUSSE SMOLLETT SHE FEELS HE IS ANNOYING BUT THAT IS AS MUCH AS SHE THINKS ABOUT THAT BECAUSE OF THE OTHER THINGS HER OFFICE HAS TO DO. WE HIT ON THE OTHER TOPICS WITH FOXX YOU CAN WATCH THE FULL INTERVIEW ON OUR WEBSITE AND THERE ARE TWO CANDIDATES FACING OFF IN THE G.O.P. PRIMARY FOR STATE’S ATTORNEY, CHRISTOPHER FOND COOK AND PAT O’BRIEN WE WILL HAVE BOTH SETS OF CANDIDATE FORUMS ON “CHICAGO TONIGHT.” SMOLLETT IS EXPECTED TO APPEAR IN COURT ONE WEEK FROM TODAY.>>IT’S STILL HAPPENING. THANK YOU.>>AND FOR MORE ON THE RACE FOR COOK COUNTY STATE’S ATTORNEY AND OTHER OFFICES VISIT OTHER WEBSITE FOR THE 2020 VOTER GUIDE. YOU WILL HEAR FROM THE CANDIDATESTH THEIR OWN WORDS ON WHY THEY THINK THEY ARE THE BEST QUALIFIED FOR THE JOB AND WHERE THEY STAND ON THE ISSUES THAT IS AT WTTW.COM/NEWS.>>>AND NOW TO MORE OF WHAT IS MAKING NEWS IN CHICAGO TONIGHT. IF YOU ARE A CUBS FAN AND A HULU LIVE TV SUBSCRIBER YOU ARE IN LUCK THE MARQUEE SPORTS NETWORK IS ANNOUNCING YOU WILL ACCESS EVERY PRESPRING TRAINING GAME AND REGULAR SEASON GAMES WHEN THEY BEGIN STREAMING ON HULU. THE TEAM HAS HOWEVER YET TO MAKE A DEAL WITH COMCAST TO CARRY THE NETWORK ON THE CABLE SYSTEM POTENTIALLY LEAVING MILLIONS OF VIEWERS WITHOUT CUBS TELECASTS. IN ADDITION TO THE GAMES THE MARQUEE NETWORK WILL BROADCAST CUBS CONTENT AND ORIGINAL SPORTS PROGRAMMING WHEN IT DEBUTS SATURDAY FEBRUARY 22. THAT IS WHEN THE CUBS WILL TAKE ON THE OAKLAND A’S IN THE FIRST SPRINGING TRAIN — SPRING TRAINING GAME IN ARIZONA.>>YOU MAY HAVE FORGOTTEN TODAY IS A HOLIDAY. MOST FEDERAL AND LOCAL GOVERNMENT INSTITUTIONS WERE CLOSED IN OBSERVANCE OF PRESIDENT’S DAY, POST OFFICE, SCHOOLS AND COUNTIES AND BANKING INSTITUTIONS AND THE STOCK MARKET. THE BONUS IS ADMISSION WAS FREE TODAY FOR ILLINOIS RESIDENTS AT MANY POPULAR MUSEUMS LIKE THE CHICAGO HISTORY MUSEUM, THE FIELD AND THE SHED AQUARIUM. OPEN RETAIL STORES. SOME OF YOU MAY HAVE CAUGHT A SALE. AS FOR THE WEATHER TONIGHT RAIN THEN DRIZZLE THEN FOG WITH A LOW AROUND 32. TOMORROW SKIES WILL CLEAR UP WITH A HIGH NEAR 35. AND STILL TO COME ON “CHICAGO TONIGHT”, A NEW EXHIBIT ON THE LIFE AND LEGAL WORK OF RUTH BADER GINSBURG. WITH FAMILY STORIES FROM HER SON.>>A NEW REPORT FROM NORTHWESTERN MEDICINE FINDS NO CLEAR RATIONALE FOR 45% OF ALL ANTIBIOTIC PRESCRIPTIONS FOR MEDICAID PATIENTS.>>BEHIND THE SCENES AT AN ART SUPPLY REUSE CENTER IN CHICAGO’S HUMBOLDT PARK NEIGHBORHOOD.>>ON THIS PRESIDENT’S DAY A LOOK AT HOW THE POWER OF THE PRESIDENCY CHANGED OVER THE YEARS.>>ACROBATS FROM CAST MEMBERS OF TEATRO ZINZANNI. AND REPORTS OF A WORKER BERATING SPANISH SPEAKING CUSTOMERS INSIDE A PILSEN POST OFFICE FIRED UP MANY OF YOU. WE HEAR YOUR THOUGHTS IN OUR VIEWER FEEDBACK SEGMENT. AND WEDNESDAY GOVERNOR J.B. PRITZKER WILL LAYOUT HIS VISION FOR THE BUDGET. HIS OFFICE HAS MADE SOME OF THAT PLAN PUBLIC. HE PLANS TO SEND MORE MONEY TO THE DCFS. WE’LL HEAR WHAT AMANDA VINICKY WHO HAS MORE.>>LET’S PUT THIS IN PERSPECTIVE. LAST COUNT MORE THAN 18,000 ILLINOIS CHILDREN ARE WARDS OF THE STATE.>>WHEN DCFS TAKES A CHILD INTO THEIR CUSTODY, THAT CHILD REALLY BECOMES OURS COLLECTIVELY AS A STATE. WE ARE NOW RESPONSIBLE AS THE PARENTS. AND WHEN WE DO THAT, THAT IS AN EXTRAORDINARY MEASURE THAT OFTEN HAS LONG-LASTING IMPACTS ON THE CHILD AND THIS MAY BE A CHILD WHO ALSO ALREADY SUFFERED ABUSE OR NEGLECT.>>FOR BUT DECADES ILLINOIS HAS DONE POORLY AT THAT JOB. SO BADLY THAT IN THE 80s THE C: A.C.L.U. SUED THE GOVERNMENT’S HAND TO DO BETTER A COURT MONITOR IS OVERSEEING THINGS. PROBLEMS CONTINUE TO PLAGUE THE AGENCY. THE DEATH OF FIVE-YEAR-OLD AJ FRIEND WHOSE MOTHER ADMITTED TO KILLING HIM. DCFS INVESTIGATORS SAY THEY WERE OVERWORKED WITH CASES OF ALLEGED ABUSE. AND INSPECTOR GENERAL’S REPORT SHOWING 123 CHILDREN DIED IN THE LAST FISCAL YEAR DESPITE HAVING CONTACT WITH DCFS AND REPORTS INCLUDING ONE THIS MONTH, OF FOSTER CHILDREN SHACKLED AND HANDCUFFED DURING TRIPSISM WE HAVE NEVER DONE IT WELL HERE IN ILLINOIS. WE NEED TO DO IT BETTER AND I THINK THE INFLUX OF RESOURCES IS A CHANCE TO BUILD ON THAT. BUT THAT HAS TO BE DONE IN A THOUGHTFUL, DELIBERATE, COMMON SENSE WAY. AND AS WE KNOW, THAT IS NOT ALWAYS BEEN THE HALLMARK OF DCFS.>>IT IS UNDER THIS BACKDROP THAT GOVERNOR J.B. PRITZKER’S OUT WITH A PLAN TO INCREASE FUNDING BY 20%. PRITZKER HAND PICKED DCFS DIRECTOR MARK SMITH. WANTS THE MONEY TO GO TOWARDS EXPANDING TRAINING FOR WORKERS. TOWARD TECHNOLOGY INCLUDING A NEW CASE MANAGEMENT SYSTEM AND ON SIGHT DRUG TESTING TOWARD MORE BEDS FOR YOUTH IN CARE AND GRANTS FOR REPAIRS AT GROUP HOMES. AND HIRING ANOTHER 123 STAFF NEM MEMBER AS SEEN IN BUDGET NUMBERS. SOCIAL SERVICE AGENCIES THE LIST TO COORDINATE CARE ARE SET TO RECEIVE MORE MONEY SO THEY CAN PAY THEIR WORKERS MORE MONEY IN HOPES OF REDUCING TURNOVER. THE A.C.L.U.’S SAYS IT IS A GOOD START BUT HOW THE MONEY IS UTILIZED IS MORE IMPORTANT. THAT SHACKLING INCIDENT WAS NOT A MATTER OF MONEY.>>THAT’S ABOUT COMMON SENSE. THAT’S ABOUT SAYING A CHILD HAS COME TO OUR CARE WHO LOVES THAT CHILD? WHAT IS THAT CHILD LOVE? AND WHO DO THEY LOVE AND WHAT DO THEY NEED? THOSE ARE THE QUESTIONS THAT WE SHOULD BE ASKING AND TAKING A STEPPED APPROACH AND THEN APPLYING THE RESOURCES YOU KNOW, TO ANSWER THOSE QUESTIONS.>>AND SO THIS IS CLEARLY ABOUT MORE THAN DOLLARS AND CENTS. DO WE EXPECT THE GOVERNOR TO TELL US MORE ABOUT THIS DURING HIS BUDGET ADDRESS ON WEDNESDAY? INSIGHT THERE?>>ON WEDNESDAY HE WILL SURELY SPEAK ABOUT WHAT HE IS DOING IN THE FACE OF ALL OF THE PROBLEMS. BUT WHEN IT COMES TO THE BUDGET WE HAVE A LITTLE MORE OF WHAT IS HAPPENING. HE HIGHLIGHTED WHAT HE SAYS ARE 225 MILLION DOLLARS IN EFFICIENCIES HIS ADMINISTRATION HAS ACHIEVED THROUGH STREAMLINING, TECHNOLOGY, PLANS TO CONSOLIDATE STATE FUNCTIONS. WE DON’T YET KNOW WHAT ALL ELSE HE WILL SAY. BUT ADAM FROM THE ILLINOIS POLICY INSTITUTE THINKS HE HAS A GOOD IDEA.>>WHAT I REALLY EXPECT IS THAT HE WILL PRESENT A FALSE CHOICE TO ILLINOISANS THAT THE ONLY WAY TO FIX STATE FINANCES IS WITH HIGHER TAX THROUGH THE PROGRESSIVE INCOME TAX OR CUTTING CORE GOVERNMENT SERVICES THINGS THAT PEOPLE WANT AND NEED.>>NOW, THE POLICY INSTITUTE IS A THINK TANK WITH CLOSE TIES TO BRUCE RAUNER. THE POLICY INSTITUTE ADVOCATES FOR SCALING BACK GOVERNMENT AND GOVERNMENT SPENDING. STILL SCHUSTER SUPPORTS MORE RESOURCES GOING TO DCFS.>>GENERALLY WE DO NEED TO INVEST MORE IN DCFS AND A RANGE OF OTHER AGENCIES. THE THINGS IS WE CAN’T INVEST MORE IN THOSE THINGS SUSTAINABLELY AND IN THE LONG-TERM IF THE ONLY PLAN FOR MORE INVESTMENT IS HIGHER TAXES.>>THE POLICY INSTITUTE IS ADVOCATING INSTEAD FOR A CONSTITUTIONAL AMENDMENT THAT WOULD GIVE THE STATE THE ABILITY TO SCALE BACK STATE EMPLOYEES RETIREMENT BENEFITS. THEY CITE ARE CROWDING OUT SPENDING ELSEWHERE. GOVERNOR J.B. PRITZKER IS ADAMANTLY OPPOSED TO THAT. HE IS FOCUSED ON ANOTHER CONSTITUTIONAL AMENDMENT THAT WILL BE ON NOVEMBER’S BALLOT, IT WOULD ALLOW ILLINOIS TO TAX INCOME AT GRADUATED RATES. AND WE EXPECT PRITZKER TO TALK ABOUT THAT ON WEDNESDAY.>>I’M SURE WE WILL HEAR FROM YOU THEN.>>YOU WILL.>>THANK YOU.>>WHEN SHE WAS NOMINATED TO THE SUPREME COURT IN 1993, RUTH BADER GINSBURG WAS CONFIRMED BY A 96-3 VOTE. ORIGINALLY SEEN AS A MODERATE SHE BECAME GOOD FRIENDS WITH A CONSERVATIVE JUSTICE SCALIA. AND SHE WROTE A SERIES OF FIERY DISSENTS THAT SEALED HER NOTORIETY. A MUSEUM IS LOOKING AT THE EXHIBITION WITH A MAN WHO HAPPENS TO BE HER SON.>>THERE ARE SURPRISING PHOTOS… ROBES TO TRY ON… EVEN COSHKIES IN THE — TCHOTCHKES IN THE GIFT SHOP.>>WE ARE HERE AT “NOTORIUS RBG: THE LIFE AND TIMES OF RUTH BADER GINSBURG”. IT IS AN EXHIBITION BASED OFF OF A BOOK OF THE SAME NAME THAT WAS PUBLISHED PUBLISHED IN 2015.>>OUR MUSEUM LOOKS AT THE HISTORY OF THE HOLOCAUST AND LARGER HISTORICAL MESSAGES ABOUT SOCIAL JUSTICE. WE WANT TO MOVE VISITORS FROM HISTORY INTO ACTION. AND THERE’S NO BETTER PERSON TO LOOK AT WHO COMMITTED HER LIFE TO SOCIAL JUSTICE THAN JUSTICE RUTH BADER GINSBURG.>>AND THERE ARE HOME MOVIES OF THE JUSTICE AND HER LATE HUSBAND MARTIN. AND COURTROOM SKETCHES AND YEARBOOK PHOTOS OF THE YOUNG WOMAN BORN JOAN RUTH RUTH BADER.>>THERE ARE OBJECTS ON LOAN FROM THE JUSTICE FROM THE SUPREME COURT AND FROM THE SMITHSONIAN.>>WE TOURED THE EXHIBIT WITH HER SON WHO DROPPED OUT OF THE UNIVERSITY OF CHICAGO LAW SCHOOL TO START THE CHICAGO CLASSICAL MUSIC LABEL AND ASKED HIM ABOUT LIFE AT HOME.>>I DIDN’T KNOW IT WAS TOO DIFFERENT FROM OTHER HOUSEHOLDS GROWING UP IN THE 70s WITH TWO HIGH-POWERED WORKING PARENTS. DINNERTIME WAS FAMILY TIME. AND THEY WERE STILL THERE TO MAKE SURE I DID MY HOMEWORK AND THE REST. SO IT FELT NORMAL TO ME. MUSIC WAS ALWAYS PLAYING IN THE HOUSEHOLD. AND YOU THAT WAS SOMETHING THAT I OBVIOUSLY I HELD ON TO AT AN EARLY AGE. MY PARENTS HAD THE TOSCANINI BEETHOVEN SYMPHONIES, BY THE TIME I WAS 7 I WAS STARTING TO COLLECT MY OWN RECORDINGS. NOT ALL MY CLASSMATES MOTHER’S WORK SO I KNEW IT WAS A LITTLE BIT DIFFERENT. BUT IT WAS VERY MUCH MORE DIFFERENT FROM MY SISTER WHO IS 10 YEARS OLDER THAN ME. I TELL THE STORY WHEN SHE WAS ON A PLAY DATE, 5 OR 6 AND OVERHEARD HER FRIEND’S MOTHER SAY BE NICE TO JANE HER MOMMY WORKS.>>AND WORKED SHE DID.>>SHE STARTED THE WOMEN’S RIGHTS PROJECT AT THE A.C.L.U. AT THE BEGINNING OF THE 70s. SHE HAD BEEN TEACHING AT RUTGERS AND BECAME THE FIRST TENURED WOMAN PRO FOESER IN COLUMBIA AND WAS APPOINTED TO THE APPEALS COURT IN WASHINGTON.>>NOW, IN HER 27TH YEAR ON THE SUPREME COURT, RBG HAS A TOURING MUSEUM EXHIBIT THAT AIMS TO PLEASE FANS AND LEGAL SCHOLARS.>>THERE IS A QUOTE IN THE EXHIBITION THAT SHE HAS TRIED IN HER LIFE TO TAKE THE SKILLS AND ABILITIES THAT SHE HAD AND PUT THEM WITH VERY HARD WORK AND EFFORT INTO THE THINGS THAT SHE FOUND THE MOST IMPORTANT. AND THAT WAS TO WORK FOR GENDER EQUALITY AND TO FIGHT INJUSTICE IN HER WORK. AND I THINK SHE WOULD ENCOURAGE US ALL TO DO THE SAME.>>THE SHOW IS CALLED THE “NOTORIUS RBG: THE LIFE AND TIMES OF RUTH BADER GINSBURG” IT’S THE ILLINOIS HOLOCAUST MUSEUM THROUGH AUGUST 16TH. THERE’S MORE ON OUR WEBSITE INCLUDING A LINK TO THE BLOG THAT INSPIRED THE EXHIBIT AND HER SON’S STORY ABOUT HIS MOTHER READING LEGAL BRIEFS WHILE ON GOLF OUTTINGS WITH THE FAMILY.>>EACH YEAR 23,000 AMERICANS DIE AND MORE THAN TWO MILLION ARE MADE SICK BY INFECTIONS CAUSED BY ANTIBIOTIC RESISTANT BACTERIA. OVERPRESCRIPTION OF ANTIBIOTICS HAS BEEN RECOGNIZED AS A PROBLEM BY THE MEDICAL COMMUNITY BUT EFFORTS TO COMBAT THAT ARE FALLING ON DEAF YEARS. A STUDY FOUND THERE WAS NO CLEAR RATIONALE FOR 45% OF ANTIBIOTIC PRESCRIPTIONS GIVEN TO MILLIONS OF MEDICAID PATIENTS AND MORE THAN A QUARTER PATIENTS WERE DESCRIBED ANTIBIOTICS WITH NO EVIDENCE OF A VISIT TO A DOCTOR. JOINING US IS THE AUTHOR GEOFFREY LINDER, CHIEF OF NORTHWESTERN’S FEINBERG SCHOOL OF MEDICINE’S DEPARTMENT OF MEDICINE. WELCOME TO “CHICAGO TONIGHT”.>>DURING FLU SEASON AND WE HAVE BEEN TALKING ABOUT THE CORONAVIRUS, SOME PEOPLE MIGHT BE CONFUSED ABOUT THE DIFFERENCE BETWEEN ANTIBIOTICS AND ANTIVIRALS. CLEAR THAT UP FOR US.>>THEY ARE BOTH ANTIMICROBIALS. ANTIVIRALS WILL ONLY WORK AGAINST VIRAL ILLNESSES LIKE THE FLU, LIKE THE FLU. WHEN PEOPLE USE THE WORD ANTIBIOTIC WE ARE TALKING ABOUT ANTIBACTERIAL INFECTIONS. PNEUMONIA, STREP THROAT, AND MORE SERIOUS INFECTIONS.>>TELL US ABOUT THE STUDY. WHAT QUESTIONS DID YOU SET OUT ASKING AND WHAT ANSWERS DID YOU FIND?>>WE WERE INTERESTED IN LOOKING AT ALL OUTPATIENT ANTIBIOTIC PRESCRIBING TO MEDICAID PATIENTS BETWEEN 2004-2013. THERE HAVE BEEN A LOT OF EFFORTS I AND COLLEAGUES HAVE DONE STUDIES LOOKING AT VERY SPECIFIC INSTANCES OF ANTIBIOTIC PRESCRIBING HOW WELL DO WE DO IN PRESCRIBING ANTIBIOTICS FOR ACUTE BRONCHITIS. BUT WHAT WE’RE TRYING TO DO IS LOOK AT ALL ANTIBIOTIC PRESCRIBING. AND SO WE LOOKED AT 300 MILLION ANTIBIOTIC PRESCRIPTIONS TO MEDICAID PATIENTS. AND FOUND HAD THE DISTURBING FINDINGS THAT YOU MENTIONED AT THE OPEN.>>SO YOU FOUND THAT 17% OF ANTIBIOTICS WERE PRESCRIBED TO MEDICAID PATIENTS WITHOUT ANY INFECTION RELATED DIAGNOSIS. WHY MIGHT A DOCTOR PRESCRIBE AN ANTIBIOTIC WHEN THERE IS NO INFECTION?>>THE SO THIS IS DOCTORS NOT PUTTING DOWN A CODE FOR AN INFECTION AND GIVING THE PATIENT AN ANTIBIOTIC PRESCRIPTION THAT SAME DAY. AND SOME OF IT MIGHT BE BAD CODING. WE DON’T HAVE ANY INCENTIVE TO KEEP TRACK OF ANTIBIOTIC SPRING HONOR WHY THEY ARE PRESCRIBED THAT IS A PROBLEM IF WE ARE TRYING TO GET OUR HANDS AROUND THE ANTIBIOTIC PRESCRIBING AND USE THE PRECIOUS MEDICINES CAREFULLY NOT KNOWING WHY THAT 17% WAS NOT PRESCRIBE SECOND A PROBLEM.>>HOW ABOUT THE 28% OF PRESCRIPTIONS THAT DID NOT SEEM TO INVOLVE A VISIT TO A DOCTOR HOW DO YOU GET AN ANTIBIOTIC PRESCRIPTION WITHOUT SEEING A DOCTOR WITHOUT A DOCTOR’S NOTE?>>LET’S SAY THIS IS JUST IN THE ABSENCE OF AN INPERSON VISIT. SAY YOU CALL YOUR DOCTOR AND SAY I HAVE A COUGH AND I WOULD LIKE AN ANTIBIOTIC AND THE DOCTOR CALLS IN A PRESCRIPTION. THERE IS NO VISIT AND NO DIAGNOSIS BUT THERE IS A RECORD OF JUST THE ANTIBIOTIC PRESCRIPTION. AND IT IS A LITTLE BIT SHOCKING THAT THAT ACCOUNTS FOR A THIRD OF ALL ANTIBIOTICS PRESCRIBED IN THE UNITED STATES.>>AS A PHYSICIAN HOW DO YOU VIEW THAT? IS THAT GOOD OR BAD?>>I HAVE CONCERNS. I DON’T THINK WE SHOULD NEVER PRESCRIBE THE NON-VISIT-BASED ANTIBIOTICS. THERE IS A ROLE FOR IT. WOMEN ARE URINARY TRACK INFECTIONS WITH TYPICAL SYMPTOMS. TEENAGERS GETTING TREATED FOR ACNE AND OTHER INSTANCES IT’S PERFECTLY REASONABLE TO HAVE A NON-VISIT BASED ANTIBIOTIC PRESCRIBING. BUT WHEN WE LOOK AT THE AMOUNT THAT THESE ARE PRESCRIBED AND THE TYPE OF ANTIBIOTICS IT DOESN’T MAKE SENSE. THERE ARE A LOT OF PEOPLE CALLING IN WITH RESPIRATORY SYMPTOMS THAT ARE PROBABLY COLDS, BRONCHITIS OR THE FLU THAT DO NOT NEED TO BE TREATED WITH ANTIBIOTICS THAT THE DOCTOR IS SENDING IN A PRESCRIPTION.>>DOES YOUR STUDY SUGGEST THAT ANTIBIOTICS ARE BEING OVERPRESCRIBED?>>WE KNOW ANTIBIOTICS ARE OVERPRESCRIBED IN THE UNITED STATES. SO THE OVERALL ANTIBIOTIC PRESCRIBING RATE IS 800 PRESCRIPTIONS PER 1,000 AMERICANS. IN ENGLAND THAT NUMBER IS 600 AND IN SWEDEN IT’S 325. AND THE SWEEDS ARE NOT DROPPING DEAD OF INFECTIOUS DISEASES. AND THEY HAVE A TARGET TO GET THAT NUMBER DOWN TO 250 PRESCRIPTIONS. OUR ANTIBIOTIC PRESCRIBING RATE IN THE UNITED STATES IS TWO-AND-A-HALF TIMES WHAT IT IS IN SWEDEN. AND A LOT OF THAT WE KNOW IS FOR INAPPROPRIATE REASONS.>>WHY DO YOU THINK WE’RE DOING THIS? IS IT PATIENT DEMAND? OR LACK OF INFORMATION TO THE DOCTOR?>>WELL, I THINK DOCTORS KNOW WHEN THEY SHOULD BE PRESCRIBING ANTIBIOTICS. WHEN WE TALK TO DOCTORS ABOUT INAPPROPRIATE ANTIBIOTIC SURPRISINGLY, WE HEAR OVER AND HERE THE REASON IS BECAUSE THEY THINK PATIENTS WANT ANTIBIOTICS. BUT TURNS OUT A BETTER PREDICTOR OF PATIENTS IS THE DOCTOR THINKING THE PATIENT WANTS AN ANTIBIOTIC. SO THERE IS A LITTLE BIT OF A DISCONNECT WE AS DOCTORS OFTEN MISINTERPRET PATIENTS’ QUESTIONS AND REQUESTS AND CONCERN ABOUT THEIR ILLNESS FOR IMPLICIT REQUEST FOR ANTIBIOTICS WHEN PATIENTS MAY NOT BE REQUESTING ANTIBIOTICS.>>DOES THERE NEED TO BE PUBLIC HEALTH TRAINING FOR THE REST OF US LAY PEOPLE THAT YOU DON’T NECESSARILY NEED AN ANTIBIOTIC?>>ABSOLUTELY. FOR YOUR VIEWERS I TELL THEM IF YOU’RE SEEING YOUR DOCTOR JUST A STATEMENT THAT I ONLY WANT AN ANTIBIOTIC IF I NEED IT, COMPLETELY CHANGES THE THINKING IN THE DOCTOR’S MIND BECAUSE OUR PRESUMPTION IS THE PATIENT IS HERE TO GET AN ANTIBIOTIC AND IF THEY DON’T GIVE ME ONE THEY WILL BE UPSET.>>THE WORLD HEALTH ORGANIZATION SAYS THAT OVERPRESCRIPTION OF ANTIBIOTICS IS ONE OF THE REASONS FOR THE WORLDWIDE RISE IN ANTIBIOTIC-RESISTANT BACTERIA. HOW WORRIED SHOULD WE BE?>>WE SHOULD BE REALLY WORRIED. WE CAN TALK ABOUT WHAT INDIVIDUAL PATIENTS SHOULD THINK ABOUT WHEN YOU ARE SICK. BUT AS A ENTIRE SOCIETY AND GLOBALLY WE NEED TO BE CAREFUL WITH THESE MEDICINES. IF WE LOSE THE ABILITY TO — LOSE HAVING EFFECTIVE ANTIBIOTICS DOING THINGS LIKE SURGERY, CHEMOTHERAPY, TRANSPLANTS YOU CANNOT DO THOSE WITHOUT ANTIBIOTICS. SO BASICALLY, MUCH OF MODERN MEDICINE GOES OUT THE WINDOW IF WE LOSE THE ABILITY OR THE HAVING EFFECTIVE ANTIBIOTICS.>>AND CAN WE NOT TRUST MODERN MEDICINE TO KEEP DEVELOPING NEW ANTIBIOTICS?>>WE ARE SLOWLY DEVELOPING NEW ANTIBIOTICS. BUT IT IS NOT KEEPING PACE WITH THE RATE AT WHICH WE’RE LOSING THE EFFECTIVE ANDS OF OLDER ANTIBIOTICS.>>BASED ON YOUR FINDINGS WHAT NEEDS TO BE HAPPENING?>>WE NEED TO BE VERY CAREFUL HOW WE ARE USING ANTIBIOTICS. WHAT I MENTIONEDDED ABOUT YOUR VIEWERS ONLY GET AN ANTIBIOTIC WHEN YOU NEED IT. GET CHECKED OUT IF YOU THINK YOU NEED AN ANTIBIOTIC AND NOT INSISTING ON ONE OVER THE PHONE AND FOR DOCTORS NOT ASSUMING PATIENTS WANT HE ANTIBIOTICS AND WHEN WE DO PRESCRIBE ANTIBIOTICS DOCUMENTING THE REASON THEY ARE BEING GIVEN WE NEED TO GET BETTER IN UNDERSTANDING WHY ANTIBIOTICS ARE BEING PRESCRIBED AND INTERVENTIONS TO REDUCE THE RATE.>>THANK YOU FOR JOINING US.>>THANK YOU FOR HAVING ME.>>AND WE’RE BACK WITH PARIS SCHUTZ IN JUST A MOMENT. STAY WITH US.>>CHICAGO DOESN’T HAVE THE BEST TRACK RECORD WHEN IT COMES TO RECYCLING BUT ONE NONPROFIT IS TRYING TO CHANGE THAT AND IN THE PROCESS PROVIDE A WIDE RANGE OF ART SUPPLIES AND MATERIALS AT AN AFFORDABLE PRICE. WE STOPPED BY FOR A VISIT. HERE IS ANOTHER LOOK. FROM ONE PERSPECTIVE MOST OF THE INVENTORY AT THE WASTESHED IN HUMBOLDT PARK COULD BE CALLED GARBAGE. BUT FROM ANOTHER THE OLD PAINTBRUSHES HALF FULL BOTTLES OF PAINT ARE FULL OF POTENTIAL JUST WAITING TO BE GIVEN A SECOND LIFE.>>THE WASTESHED IS A CREATIVE REUSE CENTER. THE MISSION IS TO KEEP REUSABLE ART MATERIALS, SCHOOL SUPPLIES AND CRAFT SUPPLIES AND MATERIALS FOR MAKING AND TEACHING OUT OF THE LANDFILL AND AFFORDABLE FOR THE COMMUNITY.>>ELEANOR RAY FOUNDED WASTESHED TO KEEP USED ART SUPPLIES FROM ENDING IN THE TRASH AND RESELL THEM. SHE WAS INSPIRED BY A REUSE CENTER IN OREGON CALLED SCRAP AND WHEN SHE MOVED TO CHICAGO SHE REALIZED THERE WAS NOT ANYTHING LIKE IT HERE.>>IT WAS BRINGING WHAT I NEED TO BE A SUCCESSFUL MODEL TO CHICAGO AND TRYING TO ADAPT IT TO WHAT CHICAGO NEEDS AND HOW CHICAGO MAKES.>>RAY SAYS THE STORE STOPPED MORE THAN 50 TONS OF MATERIALS FROM BEING THROWN AWAY WITH 45,000 POUNDS SAVED LAST YEAR ALONE.>>IT IS NICER ART SUPPLIES BECAUSE THOSE ARE IN DEMAND AND WE CAN’T KEEP ACRYLIC PAINT OR CANVASS OR THAT SORT OF THING ON THE SHELVES. THEY COME IN AND THEY ARE GONE.>>THE WASTESHED STRIVES TO BE A RESOURCE FOR EDUCATORS WHO COME TO BUY SUPPLIES FOR STUDENTS ON THE CHEAP. OR EVEN FOR FREE.>>LOTS OF EARLY CHILDHOOD EDUCATION AND LOTS OF ART TEACHERS. SCIENCE TEACHERS. A RANGE OF DIFFERENT FOLKS.>>AND THERE IS A LOT OF STUFF THE STORE CANNOT ACCEPT BECAUSE THEY DO NOT HAVE THE SPACE BUT THAT DOESN’T STOP UNCONVENTIONAL ITEMS FROM ENDING UP THERE.>>IT’S THE GOOD AND THE BAD AND THE UGLY BUT WE GET VINTAGE PATTERNS OR WE GOT IN THIS CHILDREN’S DRESS FORM.>>THE WASTESHED IS FUNDED BY SALES. WITH THE REST MADE OF THROUGH GRANTS. BESIDES RAY THERE ARE PART-TIME STAFF MEMBERS AND VOLUNTEERS. ONE OF THEM IS SUSAN GOMEZ. AN ARTIST WHO TEACHES ART TO SENIORS AROUND CHICAGO.>>I GO TO THE RESALE SHOP ALL THE TIME AND ART SUPPLIES ARE A HIT OR MISS. SO I CAME HERE AND FELL IN LOVE. I WAS LIKE GOD, EVERYTHING I COULD EVER WANT. TOOLS, CRAFTING, PAPER, PENS ALL OF IT.>>GOMEZ WILL STOP BY THE STORE ON HER WAY HOME FROM TEACHING TO VOLUNTEER AND PICK UP NEW AT LEAST TO HER, SUPPLIES. BUT IT’S NOT JUST THE LOW PRICES THAT KEEP HER COMING BACK. IT’S THE SENSE OF COMMUNITY.>>I GET TO DO MY PASSIONS WHICH IS ART. I GET TO MEET PEOPLE BECAUSE I LIKE TO TALK. AND I LOVE HANGING OUT HERE AND GET ALL THE DIFFERENT IDEAS.>>ART IS A LOGICAL PLACE TO ENGAGE WITH ENVIRONMENTAL ISSUES BECAUSE YOU CAN MAKE IT OUT OF ANYTHING. YOU CAN MAKE IT ANYWHERE. AND THERE IS NO REASON TO BUY NEW MATERIALS FOR ART LIKE MOST OF THE TIME UNLESS YOU HAVE A SPECIFIC THING THAT YOU ARE TRYING TO DO.>>THE WASTESHED IS OPEN TUESDAYS THROUGH SUNDAYS IN HUMBOLDT PARK AND YOU CAN FIND OUT MORE ON OUR WEBSITE. MUCH HAS BEEN SAID ABOUT THE WAYS PRESIDENT TRUMP IS CHANGING THE PRESIDENCY. TODAY ON THIS PRESIDENT’S DAY WE THOUGHT WE WOULD LOOK BACK AT THE WAYS THE PRESIDENCY EVOLVED FROM THE BEGINNING OF THE REPUBLIC TO THE PRESENT. AND JOINS US IS WILLIAM HOWELL A POLITICAL SCIENTIST AT THE UNIVERSITY OF CHICAGO WHO SPECIALIZES IN THE PRESIDENCY. GOOD TO SEE YOU AGAIN. OF THE EXECUTIVE BRANCH THE POWER HAS EVOLVED WHAT IT IS NOW IS NOT WHAT IT WAS AT THE BEGINNING. HOW POWERFUL WAS IT AT THE BEGINNING?>>NOT SO POWERFUL IT WAS THE SECOND BRANCH OF GOVERNMENT. THE PRESIDENT WORKED THE AT MARGINS AND THE IMPORTANT THINGS WERE DONE WERE DONE THROUGH CONGRESS AND THE PRESIDENT PLAYED A ROLE IN DIRECTING THINGS BUT DID NOT HAVE THE STAFF, THE ADMINISTRATIVE STATE WAS TINY IN COMPARISON TO WHAT IT IS TODAY. DID NOT EXERT POWERS AVAILABLE TO PRESIDENTS.>>WHAT ARE ARE THE THINGS THAT THE PRESIDENT WOULD STAY OUT OF?>>WELL, PRESIDENTS DID NOT EXERCISE POWERS THE WAY THEY DO TODAY. THEY DIDN’T HAVE A DIRECT RELATIONSHIP WITH THE AMERICAN PUBLIC AND THEN PERHAPS MOST IMPORTANTLY THE SIZE OF THE GOVERNMENT WAS TINY. IT WASN’T INVOLVED IN ALL KINDS OF DOMAINS INVOLVING HEALTH AND EDUCATION AND THE REGULATION OF THE ECONOMY. TO BE SURE THEY WERE DOING THINGS BUT NOTHING LIKE THE WORLD WE HAVE IT TODAY.>>IT WAS ALMOST CEREMONIAL BECAUSE THERE WAS A BLOWBACK AGAINST MONARCHY?>>REMEMBER, COMING OUT OF THE ARTICLES OF CONFEDERATION DEEMED ABJECT FAILURE IN ATTENDING TO PROBLEMS REVOLUTIONARY DEBT, INVOLVING THAT WE NEEDED AN INDEPENDENT PRESIDENT AND ONE THAT EXERTED SOME POWER. UNDER THE CONFEDERATION THE PRESIDENT WAS CEREMONIAL. NOT UNDER THE NEW REPUBLIC. BUT THE PRESIDENT WAS DRAMATICALLY DIFFERENT.>>AND THERE WERE PRESIDENTS THAT GREW THE POWER OF THE EXECUTIVE BRANCH AND FDR IS SEEN AS THE BEGINNING OF THE MODERN PRESIDENCY. REMIND US HOW FDR MADE THE EXECUTIVE BRANCH INTO WHAT IT IS NOW.>>YOU ARE RIGHT. THERE WERE PREDECESSORS. BUT CERTAINLY THE CULMINATION OF THE MODERN PRESIDENCY. WITH THE ECONOMY IN FREE FALL THIS IS A MOMENT WHERE THE PRESIDENT STEPS IN AND SAYS POWERFULLY THAT WE THE FEDERAL GOVERNMENT WILL ASSUME RESPONSIBILITY FOR THE AVERAGE WELFARE OF AVERAGE CITIZENS. AND THEN UNROLLS THROUGH THE NEW DEAL ALL KINDS OF EFFORTS TO JUMP START THE ECONOMY AND ATTEND TO THE HURT AND HARM CAUSED BY THE DEPRESSION, THE GREAT DEPRESSION.>>AND THE ADMINISTRATIVE STATE A LOT OF ELEMENTS OF THE ADMINISTRATIVE STATE CAME OUT OF THAT PRESIDENCY. NEW DEPARTMENTS, NEW AGENCIES?>>THE EXECUTIVE OFFICE OF THE PRESIDENCY IS BORN IN THE LATE 1930s. THE SIZE OF THE ADMINISTRATIVE STARTS TO EXPAND AND THE NUMBER OF DEPARTMENTS THE NUMBER OF AGENCIES.>>AND IF I REMEMBER MY HISTORY RIGHT IT MIGHT HAVE SKIRTED CONSTITUTIONALITY BUT THERE WAS A WAY HE DEALT WITH THAT, CORRECT?>>IT’S TRUE. THIS IS TRUE OF ALL PRESIDENTS PARTICULARLY IN THE MODERN ERA. THAT LOOK THE CONSTITUTION IS SIMULTANEOUSLY SOMETHING THEY NEED TO PAY TRIBUTE TO AND HONOR BUT THERE ARE POLITICAL AWARDS FOR ATTENDING TO THE PUBLIC GOOD BY AS ONE PROGRESSIVE HENRY JOHNS PUT IT BY BREAKING THROUGH THE CONSTITUTIONAL FORM FINDING WAYS TO SAY I WILL ATTEND TO YOU PUBLIC, BY OVERCOMING THE UNITED STATES CONSTITUTIONAL OBSTACLES THAT SUSTAINED MOO MY WAY.>>WHAT ARE THE SUBSEQUENT PRESIDENTS BROKE THROUGH AND GETTING RID OF THE OBSTACLES?>>YOU SEE THIS IN ALL KINDS OF WAYS. INDIVIDUAL PRESIDENTS INTERVENING INTO NEW POLICY DOMAINS IN CIVIL RIGHTS IN ISSUES INVOLVING THE ENVIRONMENT AND THE REGULATORY STATE. THROUGH EXERCISE OF THE UNILATERAL POWERS AND THE EXPANSION OF WHAT THE POWERS CONSTITUTE. FORGING A DIRECT RELATIONSHIP SOMETHING THAT FDR DOES THROUGH THE RADIO AND SUBSEQUENT PRESIDENTS, REVOLUTIONIZING THE KIND OF RELATIONSHIP THAT PRESIDENTS HAVE WITH INDIVIDUAL CITIZENS AND SHAPING THEIR EXPECTATIONS OF THE FEDERAL GOVERNMENT AND SHAPING OUR POLITICS MORE GENERALLY.>>WE HAD A CONSTITUTIONAL SCHOLAR, JUSTICE, JUSTICE DOUGLAS GINSBURG WHO CAME ON SAYING HE IS A CONSTITUTIONALIST AND HE BELIEVES THAT THE EXECUTIVE BRANCH IS WAY TOO STRONG AND CONGRESS HAS ABDICATED ITS RESPONSIBILITY BECAUSE IT’S POLITICALLY EXPEDIENT. DO YOU AGREE WITH THAT?>>THAT IS A PART OF THE STORY THAT CERTAINLY THE GROWTH OF PRESIDENTIAL POWER IS REMARKABLE. AND IT’S IN PART BORN OF THE PHENOMENON HE DESCRIBED WHICH IS CONGRESS WILLINGLY ASEEDING AUTHORITIES TO THE PRESIDENT. OR TIMES IT IS A RECOGNITION THAT PRESIDENTS CAN DO THINGS THAT CONGRESS CANNOT DO. AND THE STORY THAT PRESIDENTS CLAIMING AUTHORITY FOR THEMSELVES. SAYING I SHALL DO THIS AND SEEING WHETHER THEY GET AWAY WITH IT. I WOULD NOT SAY THAT THE ONLY WAY TO THINK ABOUT PRESIDENTIAL POWER IS WHETHER OR NOT IT’S TOO BIG OR TOO SMALL. WE OUGHT TO BE THINKING ABOUT IS THE KIND OF LEADERSHIP THAT WE CAN GET FROM THE EXECUTIVE BRANCH. AND HOW DO WE RESPONSIBLY LEVERAGE IT. NOT JUST A STORY WHETHER OR NOT IT’S BIG OR SMALL RELATIVE TO CONGRESS. IT’S ABOUT HOW DO WE DEPLOY PRESIDENTS IN THE SERVICE OF THE PUBLIC GOOD.>>IN RECENT YEARS, GEORGE W. BUSH, BARACK OBAMA, DONALD TRUMP THEY HAVE EXPANDED THEIR AUTHORITY. REMIND US THE WAYS THAT BUSH, OBAMA AND TRUMP HAVE DONE THIS?>>LIKE ALL PRESIDENTS FIND WAYS TO PUSH OUTWARDS. LET ME TAKE OBAMA BECAUSE HE IS THE CONSTITUTIONAL LAW SCHOLAR DOWN THE ROAD. AND HE STEPS IN IN PART WITH THE RECOGNITION OF THE VALUE OF INSTITUTIONS AND THE VALUE OF THE CONSTITUTION. A MOVE THAT HE MAKES IS HE EFFECTIVELY UNDERMINES THE SIGNATURE DOMESTIC POLICY ACHIEVEMENT OF HIS PREDECESSOR BUSH NO CHILD LEFT BEHIND.>>EDUCATION POLICY.>>EXACTLY. WHICH DEMOCRATS AND REPUBLICANS BOTH RECOGNIZED AS BEING A REAL PROBLEM THAT CONGRESS COULD NOT GET ITS ACT TOGETHER TO FIX IT. SO WHAT OBAMA DOES IS HE PROVIDES WAIVERS TO STATES, ONE AT A TIME. THAT ARE SELECTIVE. HE SAYS WE ARE GOING TO LET YOU AVOID THE DICTATES OF THIS LAW. IF YOU ADOPT AT THE STATE LEVEL SET INITIATIVES I WOULD LIKE TO SEE ADOPTED. AND HE RECONSTITUTES EDUCATION POLICY AROUND THE COUNTRY BY MAKING INROADS ABOUT SOMETHING PASSED LEGISLATIVELY.>>YOU WROTE AN ESSAY ARGUING THAT PERHAPS THE EXECUTIVE BRANCH SHOULD HAVE MORE POWER THAT IS BETTER FOR POLICY MAKING.>>IN CERTAIN WAYS NOT GENERALLY, NOT THIS IS NOT A STORY WE NEED TO GIVE MORE POWER TO THE PRESIDENT. BUT WE DO ARGUE THAT PRESIDENTS SHOULD PLAY A ROLE IN AGENDA SETTING THAT THEY SHOULD PLAY A ROLE IN SETTING THE PROPOSING THINGS BEFORE CONGRESS AND CONGRESS OUGHT TO HAVE AN OBLIGATION TO VOTE ON THE PROPOSALS THAT ARE PUT FORWARD BY THE PRESIDENT. WE HAVE A BOOK COMING OUT IN JUNE THAT LAYS OUT A SPECIFIC WAYS IN WHICH PRESIDENTIAL POWER OUGHT TO BE CURTAILED AND THIS IS AGAIN ALL IN THE SERVICE OF TRYING TO REIMAGINE WHAT THE PRESIDENCY OUT TO PLAY.>>THE ARGUMENT YOU ARE MAKING IS AT THE BEGINNING IT WAS A DIFFERENT COUNTRY THAN IT IS NOW.>>RADICALLY DIFFERENT.>>THE CONSTITUTION WAS WRITTEN FOR A DIFFERENT COUNTRY.>>95% OF PEOPLE WERE FARMERS. 800,000 PEOPLE WERE SLAVES. WE WERE AN ISOLATED COUNTRY WITH A TINY ECONOMY. AND THE KINDS OF CHALLENGES THAT WE FACE REQUIRE NEW INSTITUTIONS BUT THE BASIC FRAMEWORK WE HAVE IN LARGE PART MIRRORS WHAT WE INHERITED.>>WE LOOK FORWARD TO THE BOOK.
